Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions.
The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• Art Patronage refers to actively and regularly engaging in financial support to artists and art institutions. This does not include activities that everybody does anyway, such as engaging with art in social media, going to the movies, watching streamers online, or offering non-tangible resources such as "emotional support" or "payment by exposure".

• Artistic Value is described, not prescribed, and is applicable to any creative medium that exists as a byproduct of any degree of input, be that input (in part or in whole) intentional or unintentional, stochastic or deterministic.

• Blog (referred to as either "Blog?", "Blog!", or "Blog") refers to this website and all content therein.

• It's Our Blog, We Can Do What We Want (also referred to as its-our-blog-we-can-do-what-we-want.com) refers to the entity Blog.

• Company (referred to as either "the Company", "We", "Us" or "Our" in these Terms and Conditions) refers to Blog.

• Country refers to: United States

• Cyberbullying refers to the use of electronic communication to bully, harass, or intimidate others. Blog does not tolerate Cyberbullying in any way, shape, or form. Moreover, Blog does not tolerate Users who either engage in Cyberbullying or belong to groups or ideologies that actively promote and encourage Cyberbullying.

• Device means any device that can access the Service, including but not limited to a computer, a cell phone, or a digital tablet.

• Human-Made is a dogwhistle for "not generated by AI", which is increasingly weaponized as a justification for Cyberbullying.

• Higher Education refers to the pursuit of knowledge and skills beyond the level of basic education in institutions such as colleges and universities.

• Hyperbole refers to an exaggerated statement or claim not meant to be taken literally.

• Hypocrite refers to a person who acts in contradiction to their professed beliefs or principles.

• Low Frequency Oscillators (also referred to as "LFOs") are electronic circuits that generate low-frequency signals, typically below 20 Hz, which are used to modulate various parameters of sound synthesis and audio processing. These are not Human-Made.

• Multidisciplinary Background refers to an educational or professional background that draws from multiple academic disciplines or fields, particularly from disparate fields such as the humanities IN ADDITION TO the sciences.

• Plunderphonics refers to a musical genre that involves the use of pre-existing audio recordings, which are manipulated and rearranged to create new compositions. It is often associated with the practice of sampling in music production.

• Prescriptivism refers to the belief that certain rules and standards should be enforced in language, behavior, or other areas of life, often based on traditional or established norms. See also Prescriptivist.

• Prescriptivist refers to a person who advocates for the enforcement of strict rules and standards in language, behavior, or other areas of life.

• Service refers to the Website.

• Terms and Conditions (also referred to as "Terms") means these Terms and Conditions, including any documents expressly incorporated by reference, which govern Your access to and use of the Service and form the entire agreement between You and the Company regarding the Service. These Terms and Conditions have been created with the help of the Terms and Conditions Generator. These have been of course been reviewed and tailored with significant human input. Nevertheless, if You are driven to Hyperbole, then to you, a robot did it and Your mind short-circuits there. And that means everything is going to get replaced by robots because You saw it in Terminator, which is why Dune needs to happen. If you are a Hypocrite and a Prescriptivist who prefers Human-Made things, then You see no problem with doxxing actual humans and tormenting dissenters into committing suicide, which are examples of Cyberbullying. The Company does not understand how that line of thinking at all serves to support or uplift humanity, but we are not Prescriptivists, so You do You. If You did not complete Higher Education and/or lack a sufficient Multidisciplinary Background, then We are less than surprised with your lack of literary analysis and critical thinking skills. Most importantly, however, if this is the case, the Company reiterates that the Company does not at all condone Your actions, and You are not welcome here.

• Third-Party Social Media Service means any services or content (including data, information, products or services) provided by a third party that is displayed, included, made available, or linked to through the Service.

• Website refers to Blog, accessible from https://its-our-blog-we-can-do-what-we-want.com/

• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

You also represent that you do not belong to groups or ideologies that engage in or promote said behaviors. Those who cannot in good faith make these representations are not permitted to use the Service.

You represent that your fiduciary contributions towards activities that constitute Art Patronage exceed $100 USD monthly. The Company does not permit those who do not actively support the humanities to use the Service.

You represent that you have completed Higher Education at least once, and that your experiences constitute a Multidisciplinary Background as described above. The Company does not permit those who lack a proven ability to learn, as well as those who do not understand what learning is, to use the Service. Additionally, the Company does not permit those with an excessively narrow understanding of the humanities, sciences, and technological fields of research to use the Service.

You represent that you have had the experience of actively engaging in MULTIPLE creative endeavors across MULTIPLE disciplines, including but not limited to creative writing, fine art, music composition, and software development. You also represent that you are currently and actively engaging in said creative endeavors. The Company does not permit those who have not had such experiences to use the Service.

You represent that you bear complete understanding of the water cycle and acknowledge that water is a renewable resource.

You represent that you bear complete understanding of art history as it manifests on a worldwide, multicultural scale, and that you are familiar with (or will be capable of familiarizing yourself with) all classical and contemporary art movements, from prehistory to the present.

You acknowledge that ALL internet services necessitate the use of data centers, whether it be for server-side logic or media storage and distribution. This includes services such as Twitch, Spotify, and Discord.

You acknowledge that Cyberbullying against people who engage in generative AI usage is a Human-Made phenomenon. We reiterate that we do not condone Cyberbullying, either direct or indirect, in any way, shape, or form.

You represent that, if and when requested, you will be able to provide sufficient proof of all the above representations upon request by the Company, and that you will provide such proof in a timely manner.

Our Service does not collect, use, and/or disclose personal information whatsoever. This is due in part to the fact that the Service provides no means for user interaction, other than reading the content.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Links from a Third-Party Social Media Service

The Service may display, include, make available, or link to content or services provided by a Third-Party Social Media Service. A Third-Party Social Media Service is not owned or controlled by the Company, and the Company does not endorse or assume responsibility for any Third-Party Social Media Service.

You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with Your access to or use of any Third-Party Social Media Service, including any content, goods, or services made available through them. Your use of any Third-Party Social Media Service is governed by that Third-Party Social Media Service's terms and privacy policies.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to $5 USD.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
